Verdict June 29, for individual participation in presidential elections

The case concerns the eligibility of Dr. Mohamed ElBaradei and any individual who wishes to be nominated as an independent during the presidential elections in 2011.

The appeal filed by MP Mohamed Al-Omda is expected to be decided by Counselor Adel Farghali after looking into the challenges which include the constitutional amendments. Article 76 amendments which concern Presidential election and the support of 259 elected members of both the Parliament and the Shura Council given the candidate belongs to a political party established not less than 5 years needs modification. The article clearly contradicts article 62, which authorize the citizen to elect, express opinion in referendums according to the law provisions, and according to the contribution to public life and national duties.

 Omda has also challenged the legality and validity of elections without judicial supervision and monitoring, and the lack of appointing a higher presidential elections’ committee.

The Egyptian presidential election which is due to be held in September 2011 is considered the second presidential election in the history of Egypt .
