President Is Not Entitled To Refer Civilians To Military Tribunals, Says MB Attorney

Muslim Brotherhood Chief Attorney Abdul-Monem Abdul-Maqsoud said that the President is not entitled to refer civilians to a military tribunal.


Brotherhood defense panel filed a memorandum last Saturday to the Higher Administrative Court that will be examining the challenge submitted by the government against the cancellation of President Mubarak’s decision to refer MB leaders to the military court on December 27.


The panel asserted that such a referral is against the country’s constitution and law as well as the right to be trialed before fair and civilian court.


Abdul-Maqsoud indicated in statements to Ikhwanweb that the MB leaders should be released immediately if the court refused the government’s challenge.


Last May, the administrative judiciary passed a historic ruling revoking the President’s decision that referred 40 MB leading figures, including the MB deputy chairman Khairat El-Shater, to the military tribunal.
