Al Shater’s Defence: Ball Now In Mubarak’s Court

Al Shater’s defense panel said that all legal procedures were completed, including notifying the plaintiffs of the State Court’s landmark ruling of acquitting and immediately releasing all MB leaders.
 
 
Lawyer Sayed Abul Ela, a member of the defense panel of Muslim Brotherhood (MB) detainees stated that all legal procedures were completed, including notifying the plaintiffs of the State Court’s landmark ruling of acquitting and immediately releasing all MB leaders detained pending trial No. 963 high state security of the year 2006, dubbed “Al-Azhar incidents case”, and sending the lawsuit’s file back to the competent justice to continue hearing it.
 
Abul Ela added in a statement to Ikhwanweb:” We are now waiting for the president, attorney general and Defense Ministry implement or appeal the ruling after the Administrative Court stopped yesterday implementing the decision issued by the president of referring 34 Muslim Brotherhood leaders to the military court over money laundry case.
 
Abul Ela added that the defence team for the 34 of the Muslim Brotherhood leaders started to take the legal procedures, of notifying the plaintiffs to implement the ruling, including the president, the Defense Ministry and the attorney general.
 
“We are waiting for others’ reactions after a ruling was issued for stopping implementing the decision of the president of referring Muslim Brotherhood leaders to a military court.
 
Asked about the defence team’s role in this stage, Abul Ela said all measures have been taken and the defence team did its role well.
 
Asked whether there is any other measures, Abul Ela said that the ball is now in the court of the president, the attorney general and the Defense Ministry.
 
It is worth mentioning that In a historic ruling, Egypt’s administrative Court accepted on Tuesday an appeal filed by 33 Muslim Brotherhood members and more than 100 of their family members against the President’s order to refer them MB detainees to a military court. The court ruled to cancel the President’s decision and ordered the immediate release of all detainees and compensating them for their suffering.
 
The court said in its ruling that the president isn’t authorized to refer civilians in a civilian case to the military justice, and outrightly rejected the presidential decision and ordered compensating the 40 Brotherhood detainees for physical, psychological and moral damages after the unjust decision of referring them to the military justice.
 
The court said that its ruling is based on rules of fair courts according to the Egyptian constitution and international standards that demand that a person stands trial before his competent judge.
