The military Tribunal trying Muslim brotherhood (MB) topped by was adjourned till Tuesday, Jan, 8th, 2008. Sunday”s session against the MB leaders, topped by Khairat Al-Shater the seconded deputy chairman of the group and Mohamed Ali Beshr a member of the Executive Office, started with a pleading for businessman Hassan Malek. Dr. Mohamed Mandour, the lawyer of Hassan Malek, Dr. Essam Hashish, Dr. Abd Al-Rahman Saudi, hajji Hassan Zalat, discussed in his pleading the legitimacy of the Muslim Brotherhood group, confirming that the group abided when it was founded by the charities law.
It remained under this law and under supervision of the Ministry of Social Affairs and when it was dissolved in 1949, this decision was challenged at the Court of Cassation which issued its ruling of canceling the dissolution decision and considering the group legitimate and legal.
Mandour added that the word “an outlawed group” has no legal or real foundation and that it is used to create a media fuss. Mandour confirmed that he demanded the prosecution submit what proves that the Muslim Brotherhood group is an outlawed group to convict these accused for this.
For his Hazem Abu Ismail, Al Shater”s lawyer, said that there is an unknown authority that shoots with a video camera what takes place in the pleading. He said he asked the chief justice to reveal the identity of the ones responsible for this camera because the court prevents the media from attending the sessions and prevents lawyers from bringing cameras with them into the court.
“That a specific authority take footages of these pleadings means that this specific authority may exploit what takes place in these sessions to arrest lawyers in the future”, Abu Ismail said.
The court adjourned its session till Tuesday Jan, 8th, 2008, to complete the pleading.
